Sri Vinod Kumar Singh, Advocate appearing on behalf of petitioner no.1 submits that during pendency of the present writ petition, the services of the petitioner has been regularized. He further submits that similarly, services of petitioner nos. 3 and 4 have also been regularized and as such, the petition has become infructuous, in view of the aforesaid, regularization order subsequently passed. No further relief is required to be granted at this stage.

Sri Pulak Ganguly, learned counsel for the petitioner no. 2 submits that the service of the petitioner has not been regularized and that he may be granted liberty to approach the Regional Level Committee for considering the claim for regularization in accordance with law. Learned counsel for the petitioner No. 2 further submits that during pendency of the present writ petition, petitioner no. 2 has retired, however, his claim for regularization was not considered.

Learned Standing Counsel has no objection in case the petitioner no.2 approaches the Regional Level Committee for regularization.

Considering the aforesaid facts and circumstances of the case, the present writ petition in so far as petitioner nos. 1, 3 and 4 are concerned, is consigned to record on account of subsequent regularization order passed by the respondent-authorities. In so far as petitioner no. 2 is concerned, petitioner No. 2 is set at liberty to approach the respondent authority-Regional Level Committee for regularization in accordance with law. In case any such claim for regularization is filed before the Regional Level Committee/District Inspector of Schools, the same shall be considered and decided in accordance with law within a period of three months.

The writ petition stands disposed of accordingly.
