It is argued by learned counsel for the petitioner that pursuant to the advertisement being Advertisement No.49, the petitioner was duly selected for the post of Principle. Thereafter, letters were written by the Manager of the Institution to the petitioner to join the post but due to unavoidable circumstances, the petitioner was not able to join the post. Hence the candidature of the petitioner was rejected by the Manager of the Institution in question vide letter dated 21.04.2022. It is argued that after receipt of aforesaid letter, the petitioner made representation on 04.05.2022 before the respondent No.1/Additional Chief Secretary, Higher Education, Government of U.P. Lucknow to permit the petitioner to join the Institution in which the petitioner was selected or he may be placed to some other Institution. When no action has been taken in the matter, various reminders have also been by the petitioner before the authorities. It is argued that considerable time has already been lapsed but till date no final decision has been taken on the same.
