By means of present petition filed under Article 226 of the Constitution, the petitioner prays for revision of pension as he has been awarded with benefits under the Assured Career Progression benefits Scheme after attaining the age of superannuation. He submits that papers though have been forwarded to the competent authority on 19th July, 2023 as per letter issued by the Chief Medical OfÏcer, Varanasi dated 2nd September, 2023 but till date no decision has been taken.
Learned Standing Counsel submits that the authority can be directed to take proper decision in the matter in accordance with law.
In view of above, this petition is disposed of with direction to the competent authority, namely, respondent no. 4 to take appropriate decision in the matter of recommendation as made on 19th July, 2023 from the ofÏce of Chief Medical OfÏcer, Varanasi. It is expected that appropriate decision shall be taken within thirty days from the date of production of certified copy of this order.
