Heard Sri G.P.Singh, learned Advocate assisted by Sri M.M.Singh, learned counsel for the petitioner and learned Standing Counsel.

By means of present petition filed under Article 226 of the Constitution, the petitioner prayed for a writ of mandamus to command respondents to make payment of post retirement dues which is otherwise admissible except for the reasons that they were earlier implicated in criminal case being case crime no. 79 of 1996, under Section147,302,201 and 120B IPC.

It is submitted that petitioner nos. 1,2 and 3 have retired from the post of head constable on 31.07.2022, 30.07,2020 and 31.03.2022 respectively whereas petitioner no. 4 has retired on 31.10.2025 from the Sub Inspector. It is further submitted that all petitioners have been acquitted like petitioner Umashankar Singh whose case has been disposed of by this Court vide order dated 28.10.2023 passed in Writ A No. 17325 of 2023.

Learned Standing Counsel submits that as per instructions, government appeal has been filed against the acquittal order but could not dispute the fact that the present matter is identical to that of the petitioner Umashankar Singh whose petition has stood disposed of.

Accordingly, present petition is also disposed of in terms of the order passed by this Court on 28.10.2023 in Writ A No. 17325 of 2023.
