Heard learned counsel for the parties and perused the record.

Petitioner, who deserves promotion from Sub-Inspector to Inspector and his candidature came to be considered by the Departmental Promotion Committee 6th May, 2022 but on account of a pending criminal case, the decision in his case for promotion was put in a sealed cover adopting the seal cover procedure.

It is submitted that thereafter chargesheet has been filed and case is going on before the trial court. It is stated that since petitioner is not in any manner responsible for the delay in disposing of the pending criminal trial, more than a year has already expired, his claim is liable to be considered in view of the paragraph 10 of the Government order dated 28th May, 1997. Paragraph 10 of the Government order runs as under:

"(10) चयन सममिमति दቛኋरቛኋ ्ቚथमि बቛኋर आररोमपिति कቛኋममिरक ककी ्ቚरो्ቐमति पिर मविचቛኋर करनने एविवं मिमुहर बन्द ललिफቛኋफने ककी ्ቚमቅኌयቛኋ अपिनቛኋयने जቛኋनने कने बቛኋद एक विरर ककी अविलधि बबीति जቛኋनने पिर भबी इस अविलधि मिम ऐसबी अविलधि आगमणिति नहीሻ ककी जቛኋयनेगबी लजसमिम अपिचቛኋरबी कቛኋममिरक दቛኋरቛኋ अविध्यቛኋन कने कቛኋरणि जजॉच ्ቚमቅኌयቛኋ मिम मविलिम्ब हहआ। यमद आररोमपिति कቛኋममिरक कने मविरय मिम ्ቚशቛኋसनቛኋलधिकरणि ककी जजॉच मविभቛኋगबीय कቛኋयरविቛኋहबी / अमभयरोजन कቛኋ अनन्तिमि पिररणिቛኋमि ्ቚቛኋ्቎ न हहआ हरो , तिरो ऐसने कቛኋममिरकोሗ कने मविरय मिम , जरो मनलिनम्बति नहीሻ हह / चयन सममिमति दቛኋरቛኋ मनम्नललिलखिति ्ቚमतिबन्धिोሗ कने सቛኋथ तिदथर आधिቛኋर पिर ्ቚरो्ቐमति कने सम्बन्धि मिम मविचቛኋर मकयቛኋ जቛኋयनेगቛኋ।

( क ) आररोमपिति कቛኋममिरक कने मविरू्ቍ लिगቛኋयने गयने आररोपि क्यቛኋ इतिनने गम्भबीर हह मक उनकने आधिቛኋर पिर उसने भमविरय मिम भबी ्ቚरो्ቐमति सने विवंमचति रखिቛኋ जቛኋनቛኋ उपियमु्ሹ / जनमहति मिम हरोगቛኋ।

( खि ) क्यቛኋ ्ቚशቛኋसनቛኋलधिकरणि ककी जजॉच / मविभቛኋगबीय कቛኋयरविቛኋहबी अमभयरोजन कने अनन्तिमि पिररणिቛኋमि्ቚ ቛኋ्቎ हरोनने मिम कቛኋफकी समिय लिगनेगቛኋ।

( ग ) ्ቚशቛኋसቛኋलधिकरणि ककी जजॉच / मविभቛኋगबीय कቛኋयरविቛኋहबी अमभयरोजन मिम हरो रहने मविलिम्ब कने ललिए

्ቚत्य्ቌ यቛኋ पिररो्ቌ रूपि सने आररोपिमति कቛኋममिरक तिरो दरोरबी नहीሻ हह।

( घ ) आररोमपिति कቛኋममिरक करो तिदथर ्ቚरो्ቐमति मदयने जቛኋनने पिर विह अपिनने पिद कቛኋ दमुरूपियरोग अथविቛኋ जजॉच करो कमु्ቚभቛኋमविति तिरो नहीሻ करनेगቛኋ।

( ड ) यमद स्ቌमि ्ቚቛኋलधिकቛኋरबी उपिररो्ሹ खिण्ड ( क ) ( खि ) ( ग ) ( घ ) कने आधिቛኋर पिर मविचቛኋररोपिरቛኋन्ति आररोपिमति कቛኋममिरकोሗ ककी तिदथर आधिቛኋर पिर ्ቚरो्ቐति करनቛኋ उपियमु्ሹ समिझतिने हह तिरो उस दशቛኋ मिम मविभቛኋगबीय चयन सममिमति कने सቛኋमिनने मिቛኋमिलिने करो रखिቛኋ जቛኋयनेगቛኋ जरो आररोमपिति कቛኋममिरक कने सम्पिपूणिर अमभलिनेखिोሗ कने आधिቛኋर पिर उसकने कቛኋय቟ኘ कቛኋ मिपूल्यቛኋकन करनेगबी तिथቛኋ तिदथर रूपि सने ्ቚरो्ቐमति देने न कने अथविቛኋ न देने कने मविरय मिम अपिनबी सवंस्ति न ुति दनेगबी। म

( च ) यमद जजॉच ्ቚशቛኋसनቛኋलधिकरणि आमद मकसबी अन्य एजेसबी दቛኋरቛኋ करቛኋई जቛኋ रहबी हरो तिरो उस न दशቛኋ मिम उस एजेसबी कቛኋ पिरቛኋमिशर भबी इस मबन्दमु तिदथर आधिቛኋर पिर ्ቚरो्ቐमति द न ेने पिर ्ቚቛኋ्቎ मकयቛኋ न जቛኋयनेगቛኋ।

( छ ) उपिररो्ሹ ्ቚमቅኌयቛኋ कने उपिरቛኋन्ति आररोमपिति कቛኋममिरक कቛኋ तिदथर रूपि सने ्ቚरो्ቐमति मकयने जቛኋनने कने आदनेशोሗ मिम यह स्पि्ቖ मकयቛኋ जቛኋयनेगቛኋ मक ्ቚरो्ቐमति अमቇኌमि आदनेशोሗ तिक कने ललिए ककी जቛኋतिबी हह और शቛኋसन करो उ्ሹ तिदथर ्ቚरो्ቐमति करो कभबी भबी समिቛኋ्቎ कर देने कቛኋ अलधिकቛኋर हह तिथቛኋ तिदनमुसቛኋर न ऐसने कቛኋममिरक करो उस पिद पिर ्ቚत्यቛኋविमतिरति मकयቛኋ जቛኋ सकतिቛኋ हह लजस पिद सने उसने ्ቚरो्ቐति मकयቛኋ गयቛኋ थቛኋ।

( ज ) तिदथर आधिቛኋर पिर ्ቚरो्ቐति आररोमपिति कቛኋममिरक कने मविरू्ቍ चलि रहबी ्ቚशቛኋसनቛኋलधिकरणि ककी जजॉच / मविभቛኋगबीय कቛኋयरविቛኋहबी अमभयरोजन आमद कने अनन्तिमि पिररणिቛኋमि ्ቚቛኋ्቎ हरो जቛኋनने पिर उसकने मविरय मिम उसबी ्ቚकቛኋर अमቇኌमि कቛኋयरविቛኋहबी ककी जቛኋयनेगबी , जहसबी ककी जቛኋतिबी हबी यमद उसने तिदथर्ቚ रो्ቐमति न दबी गयबी हरोतिबी।

( झ ) यमद न्यቛኋयቛኋलिय दቛኋरቛኋ मकसबी तिदथर रूपि सने ्ቚरो्ቐति कቛኋममिरक करो तिकनबीककी आधिቛኋर पिर ( गमुणिቛኋविगमुणि कने आधिቛኋर पिर नहबी ) दरोरमिमु्ሹ मकयቛኋ जቛኋतिቛኋ हह और न्यቛኋयቛኋलिय कने मनणिरय कने मविरू्ቍ अपिबीलि यቛኋ उसबी आररोपि कने ललिए मविभቛኋगबीय कቛኋयरविቛኋहबी कቛኋ ्ቚस्तिቛኋवि हह तिरो उस दशቛኋ मिम समि्ቌ्ቚ

ቛኋलधिकቛኋरबी इस मबन्दमु पिर मविचቛኋर करनेगम मक आररोमपिति कቛኋममिरक करो तिदथर ्ቚरो्ቐमति पिर बनቛኋयने रखिቛኋ जቛኋय अथविቛኋ नहीሻ। "

Learned Standing Counsel submits that the matter can be directed to be examined by the competent authority strictly in accordance with law.

In view of the above, this petition stands disposed of with a direction that the respondent concerned would consider the claim of the petitioner for ad-hoc promotion during the pendency of the trial of criminal case by opening the sealed envelop if the petitioner succeeds upon the parameters as laid down in paragraph 10 of the Government order ( supra ).

Appropriate decision shall be taken by the authority within a period 30 days from the date production of certified copy of this order.

In the event petitioner has been held entitled to be promoted as per the recommendation made in the sealed cover he shall be offered ad-hoc promotion and shall be paid salary accordingly.
