Heard Sri Arvind Kumar Tiwari, learned counsel for the petitioners and learned Standing Counsel for the State.

Petitioners who are presently working as Constable in U.P. Police Department under the ex-servicemen quota ever since their respective appointments, both on 11.12.2019 and presently posted at Police Line Shamli, District Shamli want that their previous service rendered in Army may be counted towards pensionable service against the post of Constable in the department concerned. It is submitted that the controversy with regard to computation of period already rendered by ex-Army personnel for the purpose of pension has already stood settled by judicial pronouncement of this Court in the case of Hans Nath Dwivedi v. State of U.P. and Others in Writ - A No. 32139 of 2007 decided on 21.10.2010 .

3.In the above regard, petitioners claim to have already approached the Deputy Inspector General of Police (Establishment), Uttar Pradesh Police Head Quarter, Lucknow vide detailed representation dated 05.02.2022, however, the officer concerned has not passed any order in the matter till date.

Learned Standing Counsel submits that he has no objection in the event direction is issued to the Deputy Inspector General of Police (Establishment), Uttar Pradesh Police Head Quarter, Lucknow to look into and consider the grievance of the petitioner raised in his representation dated 05.02.2022 and dispose of the same strictly in accordance with law.

In view of the above, this petition stands disposed of with

a direction to the Deputy Inspector General of Police (Establishment), Uttar Pradesh Police Head Quarter, Lucknow to look into and consider the grievance of the petitioners raised in their representation dated 05.02.2022 and dispose of the same strictly in accordance with law, as expeditiously as possible, preferably within a period of three months from the date of production of certified copy of this order.

Needless to add, the Deputy Inspector General of Police (Establishment), Uttar Pradesh Police Head Quarter, Lucknow shall be providing requisite opportunity of hearing to the parties concerned before passing any final order. The order to be passed shall be reasoned and speaking one.
