Heard learned counsel for the parties.
Sri Siddharth Singhal, learned counsel for the contesting respondents has obtained instructions in the matter and as per the instructions petitioner has been declared successful in the written examination as Scheduled Tribe candidate. Now he has to appear for the physical verification of the documents and if petitioner has the certificate of S.T., there is no reason for the respondent Commission for not taking into consideration the candidature of the petitioner. He submits that unless and until petitioner presents himself along with requisite documents for verification or the same is represented no cause as such arises. He submits that physical verification of the documents is still under way.
In such above view of the matter, therefore, I decline to grant indulgence in the matter at this stage as pre-mature one with liberty to petitioner to file afresh petition as and when cause arises.
