In compliance with the interim mandamus dated 12.09.2023, a short counter affidavit has been filed today in Court on behalf of respondent no. 2 by Mr. Ravindra Singh, learned Counsel. It is taken on record. Let it be numbered by the Office.
Another short counter affidavit on behalf of respondent nos. 3 and 4 is filed today in Court by Mr. Ravindra Singh, learned Counsel. It is also taken on record. Let it be numbered by the office.
In paragraph no.4 of the short counter affidavit filed on behalf of respondent nos. 3 and 4 , it is averred:
"4. That incompliance of order passed by the Hon'ble Court, petitioner has been paid his entire post retirement dues by the Kisan Sahkari Chini Mills Ltd Ghosi Mau. The payment details are being given here under;
a) Gratuity-Rs 368205 / -payment date 03.10.2023
b) Provident Fund Rs 478868/-deposited through challan month by month in the regional office of EPFO, Varanasi c) Leave Encashment - Rs. 40189/-payment date 03.10.2023 d) Overtime Rs 62523/- date of payment 03.10.2023
e) Bonus Rs 19436/-
Total Rs 969221/-
Copy of payment details/Statement is being filed as SCA-1 to this Affidavit."
Learned Counsel for the petitioner states that the petitioner has received his dues of post retiral benefits and there are no further claims to make.
