In compliance of the order of this Court dated 16.10.2023, instruction dated 1.11.2023 has been placed before this Court which is taken on record.

Ms. Seema Agarwal, learned standing counsel, on the basis of instruction dated 1.11.2023, submitted that the revenue team was constituted and it was reported that no encroachment was found over plot nos.365, 366, 401, 436. She further submitted that in respect to certain area of plot no.244-ka, encroachment was found, accordingly, proceeding under Section 67(1) has been registered against the persons who are in possession over the same. The particulars of the cases are as follows:- Case Nos.T202314700309352, T202314700309353 & T202314700309354.

Counsel for the petitioner submitted that appropriate direction be issued for the expeditious disposal of the pending proceedings in accordance with law.

In view of the facts and circumstances of the case, without expressing any opinion on the merits of the case, this petition is disposed of with the direction to respondent no.4/Tehsildar, Tehsil Raja Talab, District Varanasi to decide the aforesaid proceedings to its logical conclusion, as expeditiously as possible, in accordance with law.
