Heard Mr. Gokaran Singh, learned counsel for the petitioner, Mr. Rameshwar Prasad Shukla, learned learned counsel for the respondent- Gaon Sabha and Mr. Shridhar Tripathi, learned counsel for State-respondent.

The instant public interest litigation has been filed for mandamus directing the respondent no.3 i.e. Assistant Collector/Tehsildar, Tehsil Ghosi, District Mau to decide the Case No.3061 of 2021, Computerized Case No.T202115510203061 (Gram Sabha Vs. Subhash and others) under Section, 67 of U.P. Revenue Code, 2006 within stipulated period.

Learned counsel for the petitioner submitted that plot in question is recorded as pond in the revenue records and the proceedings under Section 67(1) of the U.P. Revenue Code, 2006 is pending before the respondent No.3. He further submitted that copy of the order sheet of the pending proceeding is annexed as Anneuxre No.3 to the writ petition.

Without expressing any opinion on merits of the case and keeping in view of the facts and circumstances, respondent no.3 is directed to conclude the aforementioned case on merits after giving an opportunity of hearing to the parties in accordance with law expeditiously preferably within a period of four months from the date of production of certified copy of this order before him.

Accordingly, the writ petition is finally disposed of .
