Sri Mahendra Singh, learned counsel for the applicant and Sri Karunakar Singh, learned A.G.A. for the State are present.
The present transfer application has been filed to transfer the Criminal Case No. 1511 of 2019 arising out of Case Crime No. 552 of 2017, under Section 409 of I.P.C., pending in the Court of Chief Judicial Magistrate, Firozabad to any court of District Judgeship Etawah.
Learned counsel for the applicant submits that the applicant was working at the post of Assistant Officer In Charge of U.P. Food Corporation Centre Etawah. The applicant is effected from severe disease cardiac and was undergoing treatment in U.P. Rural Institute of Medical Science and Research Safai, Etawah. As per advice of doctor the applicant has never been going in journey single. The applicant is retired person. The applicant is permanent resident of district Etawah.
In view of the above facts and circumstances of the case, the present transfer application has no merit and deserves to be dismissed.
The present transfer application is dismissed accordingly.
