Sri Vashishtha Tiwari, learned counsel for the applicant and Sri Umesh Chandra Verma, learned A.G.A. for the State are present.
The present transfer application has been filed to transfer the Session Trial No. 228 of 2015 (State Vs. Shiv Charan and others), arising out of Case Crime No. 776 of 2014, under Sections 394, 302, 201, 411, 120-B of I.P.C., pending in the Court of Additional Sessions Judge, Ist, Hathras to any other adjoining district.
After some arguments, learned counsel for the applicant wants to withdraw the application with liberty to file a fresh Transfer Application under Section 408 of Cr.P.C. before the court of Sessions Judge.
In view of the above, the application is dismissed as withdrawn with the aforesaid liberty.
