Shri Daya Shankar, learned counsel for the applicant and Shri Motilal, learned A.G.A for the state are present.
The present transfer application has been filed to transfer the Case No. 20930 of 2022 under Section 138 of N.I. Act, pending in the court of Chief Judicial Magistrate-II, Gorakhpur to any other adjoining district judgeship.
Learned counsel for the applicant submits that the applicant is accused in the above noted case. It is further submitted that till today the appellant has not applied for bail in the present case. It is further submitted that on 06.08.2023 opposite party no. 2 committed marpeet with the applicant and also threatened for dire consequences and a complaint case was filed under Sections 323, 504 and cognizance has not been taken till today.
In view of the above facts and circumstances, the present transfer application has no merit and it deserves to be dismissed.
Accordingly, the present transfer application is dismissed.
