Sri Naveen Kumar, learned counsel for the applicant and Sri Ashish Kumar Srivastava, learned A.G.A. for the State are present.
The present transfer application has been filed to transfer the Case No. 653 of 2021 (Smt. Irma Shakeel @ Irma Vs. Naved Vs. Mohd. Naved Yameen), under Section 125 of Cr.P.C., pending in the Court of Principal Judge Family Court, Bareilly to any court of District Judgeship Badaun, Hapur, Moradabad and Amroha.
Learned counsel for the applicant submits that the applicant is husband of opposite party no. 2. The distance between Bareilly to Badaun is about 51 kms. The opposite party no. 2 and her family members threatened and misbehaved and also committed marpeet with him. In this regard, a complaint has been sent to SSP, Bareilly by registered post on 21.10.2022.
In view of the above facts and circumstances of the case, the present transfer application has no merit and deserves to be dismissed.
The present transfer application is dismissed accordingly.
