Sri Salman Ahmad, learned counsel for the applicant and Sri Ashwani Kumar Rai, learned A.G.A. for the State are present.
The present transfer application has been filed to set-aside the order dated 21.03.2023 passed by Chief Judicial Magistrate, Jalaun at Orai, in Case No. 859 of 2022, by which the Chief Judicial Magistrate, transfer the case to Judicial Magistrate, Konch, the case is relating to the offence under Sections 332, 353, 323, 504, 506 of I.P.C.
After some arguments, learned counsel for the applicant does not want to press the present transfer application and wants liberty to file appropriate application/ proceedings before the court of competent jurisdiction and the same may be dismissed as not pressed.
In view of the above, the present transfer application is dismissed as not pressed with the aforesaid liberty.
