Sri Amit Kumar, learned counsel for the applicant and Sri Ramesh Kumar Singh, learned A.G.A. for the State are present. Despite service of notice upon opposite party no.2, none has appeared.
The present transfer application has been filed to transfer the complaint case no. 500 of 2017 (Vikas Gupta vs. Harcharan Singh), under Section 406, 506 & 420 IPC, pending in the court of Additional Chief Judicail Magistrate III, Meerut to any competent court of Aligarh Judgship or to any other district.
Learned counsel for the applicant submits that on 16.08.2022 the opposite party threatened with dire consequences and there is probability of danger to his life at Meerut. It is further submitted that due to terror of opposite party, applicant not appeared on 18.08.2022 and non-bailable warrant was issued against him. The applicant is accused in the case.
In view of above facts and circumstances, this application has no merit and deserves to be dismissed.
Accordingly, this application is dismissed.
