Shri Dileep Kumar Mishra, learned counsel for the applicant, Shri Avdhesh Kumar Tiwari, learned counsel for the opposite party Nos. 2 to 4 and Shri Tej Bhan Singh, learned A.G.A. for the State are present.
Present Transfer Application has been filed to transfer the criminal case No. 2206 of 2018 (State Vs. Dipti Tiwari and others) arising out of case crime No. 0857 of 2017, under Sections 147, 452, 323, 504, 506, IPC, Police Station Dhoomanganj, District Prayagraj, pending in the court of Additional Chief Judicial Magistrate, Court No. 7, Allahabad to any competent court of District Pratapgarh.
Learned counsel for the applicant submits that the cross case of the incident has been transferred by a Coordinate Bench of this Court in Transfer Application (Criminal) No. 130 of 2019 on 13.9.2019 to Chief Judicial Magistrate, Pratapgarh.
Learned counsel for the opposite party Nos. 2 to 4 has not refuted the above argument of the learned counsel for the applicant.
In view of the above facts and circumstances of the case, the present transfer application is liable to be allowed.
The instant transfer application is allowed and the criminal case No. 2206 of 2018 (State Vs. Dipti Tiwari and others) arising out of case crime No. 0857 of 2017, under Sections 147, 452, 323, 504, 506, IPC, Police Station Dhoomanganj, District Prayagraj, pending in the court of Additional Chief Judicial Magistrate, Court No. 7, Allahabad is transferred to the competent court of District Pratapgarh.
