Heard Sri Dinesh Kumar Bhaskar, learned counsel for the petitioners, learned A.G.A for respondents nos. 1 to 3 and perused the record.

Present writ petition has been filed for following relief:

"(i) issue a writ in the nature of Habeas Corpus commanding and directing the Respondent Nos. 2 and 3 to produce the corpus (Petitioner No. 1) from the custody of the Respondent No. 4 either alive or dead."

This Court vide order dated 30.06.2023 directed the Station House Officer, Police Station Sidhapura, District Kasganj as well as respondent no.4 to ensure the presence of the corpus/petitioner no. 1-Smt. Rachana Soni before this Court on the next date i.e. 24.07.2023, but on that date, she could not be produced. This Court vide order dated 31.07.2023 granted further time to Investigating Officer to comply with the previous order dated 30.06.2023. In pursuance thereof, the corpus is present before the Court today.

After interacting with the corpus, she made a statement that she is willing to reside with her parents.

In view of the statement of fact made by the corpus- Smt. Rachana Soni, no cause of action survives in the present writ petition. Accordingly, the same is finally disposed of.

However, it is directed that the deposited amount of Rs. 50,000/- be paid to the corpus forthwith.
