The averments made in the petition are that petitioner no.2 and respondent no.4 are real brothers and their father, Kamta Prasad (petitioner no.1) has equally distributed the agricultural land between them. After sometime, petitioner no.1 got paralyzed and petitioner no.2 in order to cure consulted various doctor at Kanpur and Agra but the condition remains the same. On 10.08.2022, wife of respondent no.4, namely, Usha Devi i.e. respondent no.5 asked petitioner no.2 that she will take petitioner no.1 for treatment before one exorcist and she has taken guarantee that paralysis will be got cured. On this, petitioner no.2 granted permission for this. Thereafter on 18.08.2022, after a well-thought strategy, petitioner no.1 was taken to Tehsil Sadar by respondent no.5 and a gift deed was got executed of entire land of Gata No.738 in favour of Vinay and Kalicharan, the son and the son-in-law of respondent no.5. That on 10.12.2022, when the petitioner no.2 has gone to his share of land then respondent no.5 asked petitioner no.2 not to cultivate any kind of crop on the particular share of land because petitioner no.1 has made a gift deed in favour of respondent no.5.
