Heard learned counsel for the revisionists, learned A.G.A. for the State and perused the record.
This criminal revision has been filed against the order dated 28.01.2021, passed by Additional Sessions Judge / Special Judge, P.O.C.S.O. Act, Court No. 1, Gorakhpur, in Complaint Case No. 07 of 2016 (Swami Nath vs. Ramakant and others), under Sections 376D, 506 I.P.C. and Section 5/6 P.O.C.S.O. Act, Police Station Uruwa, District Gorakhpur..
After arguing the case for quite some time at length, learned counsel for the revisionists submits that the purpose of his client would suffice, if a direction may be given to the courts below to decide the bail application within specific time frame.
Learned A.G.A. has no objection to the above prayer made by learned counsel for the applicant.
However, it is directed, that in case revisionists appear and surrender before the court below within two weeks from today and apply for bail, the court below shall consider and decide the bail prayer of revisionists expeditiously in accordance with law.
With the above directions, present criminal revision is disposed off.
Till the aforesaid period of two weeks, no coercive action shall be taken against the revisionists in the aforesaid case.
