family register, it was also prepared after commission of offence in which age of father and mother of the delinquent have been mentioned and the date of birth of the delinquent has also been mentioned as 01.01.2002, on the basis of which, the delinquent becomes minor, but the authenticity of copy of family register cannot be said to be established as it being issued and prepared subsequent to the commission of offence and it is also to note that birth certificate was issued on 08.07.2019 which is subsequent to the commission of offence and there was no any mention regarding the fact from where his date of birth was verified as 01.01.2002, therefore, the authenticity of these papers was not relied by the learned Juvenile Justice Board. It is also to note that statement of father of the delinquent was recorded during the course of inquiry before the Juvenile Justice Board in which he clearly stated that his marriage was performed in the year 2002 and the delinquent was also born in the same year. In case reliance is placed on the statement as made by father of the delinquent even then it cannot be possible that the delinquent was born on 01.01.2002. In this way the date of birth as contained in the aforesaid papers and stated by father was not relied by the learned Board.
