Heard learned counsel for both the parties and learned A.G.A. for the State.

The present criminal misc. writ petition has been moved u/s 226 of the Constitution of India with the prayer for expediting the hearing and disposal of the Case No. T202113740303719 (Rizwan Vs. Rahid Jaan and others), under Section 145 Cr.P.C., Police StationNakhasa, District- Sambhal pending before SDM, Sambhal (opposite party no. 2).

Learned counsel for petitioner submits that he has moved an Application u/s 145 Cr.P.C. before opposite party no. 2. More than one years have been lapsed, but the same has not been disposed off as yet by the respondent no. 2. A perusal of the order sheet annexed with the writ petition reveals that the application is pending before 01.09.2021. The order sheet on page no. 39, shows that opposite parties have not been appeared as yet in the case. However, he seeks expeditious disposal of the petition.

Learned A.G.A. has no objection for the same.

In view of the above, petition is finally disposed off with the direction to the respondent no. 2 namely Sub-Divisional Magistrate, Sambhal to consider and decide the application u/s 145 Cr.P.C. expeditiously, preferably within a period of 6 months, from the date of production of certified copy of this order.

Accordingly, the application is disposed off.
