As per the facts of the case, an application u/s 156(3) Cr.P.C. dated 22.3.2022 was moved by the appellant against opp. party nos. 2 to 5. There was enmity between them with regard to a land and on 10.2.2022 at about 12.30 hours in the noon, when the appellant/ complainant Rohit along with his uncle Ram Kumar and brother Mohit was standing outside his house, Pankaj Dubey and Roop Narayan Dubey came there and started hurling abuses and asked the complainant why he had constructed the drain without his consent. The complainant replied that this drain had been constructed by the government. Hearing this, they got provoked and hurled caste based abuses. Just after five minutes again, Pankaj Debey, Roop Narayan Dubey with his son Neeraj Dubey and Pankaj Dubey with his brother Shiv Narayan equipped with batons in their hands came there. Seeing them, the complainant/appellant being scared entered his house along with his brother and uncle. The opp. parties forcibly entered the house of the appellant/ complainant and using caste based words assaulted the appellant with baton, kicks and fists. When his grand mother Mayadevi and brother Rohit came to rescue the appellant /complainant, they were also thrashed at the hands of the opp. parties hurling caste based abuses. They gave threat of life also to them. This incident was witnessed by Ram Kumar, the uncle of the complainant/ appellant and his other family members.
