Learned counsel for the appellant and learned A.G.A. are present.

This present criminal appeal under Section 14A(2) of SC/ST Act has been filed by the appellant against the judgement and order dated 26.04.2023 passed by Additional District & Session Judge/Special Judge POCSO Act, Court No. 13, Saharanpur in Session Case No. 982 of 2023, State Versus Akbar (Arising out of Case Crime No. 629 of 2022), under Sections 323, 354B I.P.C. and Section 7/8 POCSO Act and Section 3 (2) (Va) of SC/ST Act, Police Station Sadar Bazar, District Sasharanpur, whereby the cognizance under Sections 323, 354B I.P.C. and 7/8 POCSO Act and 3 (2) (Va) of SC/ST Act was taken against the appellant.

In the Court, learned counsel for the appellant only submitted that some direction be issued to the court concerned regarding bail as the applicant wants to surrender before the trial court.

The application is, therefore, disposed of with the direction to the trial court that if the applicant appears before the trial court within one month or till the date the applicant appears before the trial court for bail, the same shall be decided as soon as possible in view of law laid down in Satender Kumar Antil Vs. Central Bureau of Investigation and another, (2021) 10 SCC 773 .
