The present criminal appeal has been filed under Section 14-A(1) of SC/ST Act against the order dated 28.03.2018 passed by learned Additional Sessions Judge-II, Bhadohi Gyanpur by which the court took cognizance on the charge sheet in Case Crime No. 0357 of 2017, under Sections 323, 504, 506 I.P.C. and 3(1)(Da of SC/ST Act, Police Station Suriyawan, District Bhadohi pending in the court of Additional Sessions Judge-II Bhadohi Gyanpur in S.T. No. 76 of 2018 (State Versus Rakesh Kumar).
In the Court, learned counsel for the applicants only submitted that some direction be issued to the court concerned regarding bail as the applicants want to surrender before the trial court.
The application is, therefore, disposed of with the direction to the trial court that if the applicants appear before the trial court within 15 days from today and moves an application for bail before the trial court, the same shall be decided as soon as possible in view of law laid down in Satender Kumar Antil Vs. Central Bureau of Investigation and another, (2021) 10 SCC 773 .
