he was in jail and that he was not a dreaded person otherwise. This witness also stated that he and deceased were not armed. In his further cross examination PW-1 has stated that the deceased was assaulted with battle axe firstly on his head but he did not fall. The other person also assaulted the deceased with battle axe. He could not see whether the deceased was assaulted once or twice with battle axe. Roop Lal fired from the 'Tamancha' and at that time, the deceased was close to him and the distance was around 2 to 3 steps. He then stated that after Roop Lal fired upon the deceased, the other accused Hanif, Javed, Jai Narain and Hari Babu started assaulting the deceased with stick. 'Lathi' blows were given on the back and legs of the deceased. He claimed that he was at a distance of 10-15 steps behind the deceased and therefore, he does not know exactly where the other blows were caused. He further stated that Afsar and Saqeer along with other villagers later came to the place of occurrence. He also stated that he had lifted the injured and taken him to the road whereafter the report was got scribed by Anwar, who was also working with him at the 'Bidi' factory. This witness has stated that while he was lifting the deceased, bloodstains had also appeared on his clothes but he has not shown it to the police. He also stated that the murder case of Jagroop was going on against Prakash and Ramesh but other details are not known to him. He has denied the suggestion that Mahesh was not a witness in the murder case of Jagroop.
