Considering the submissions of learned counsel for the parties and after perusal of Judgment and order including the lower court record, it transpires that an information was got from the police of Punjab as well as informer that one rifle and three guns out of four guns, two rifles and a foreign camera, which were looted from Usha Farm situated at Police Station Melani, District Kheri in 1989 and in relation to which Case Crime No. 12 of 1989 under Section 394, 397 I.P.C. was registered, were given to accused appellant. On the basis of received information, S.H.O. Mukteshwar Prasad along with SI Shyam Sunder Grover, Police Station Gola, Constable Amarpal Singh, Constable Devendra Singh, Constable Rajesh Kumar Jaiswal Palia, Constable Gaya Prasad Palia , Constable Subedar, Driver Ram Kishan, Sarayan Pandey and Srikrishna raided the house of accused-appellant on instructions of Dayaram Verma Circle Officer, Palia. The accused-appellant was apprehended and at his instance, three two barrel guns, one rifle and one old camera were recovered after digging earth on the north-eastern corner of his house. Thereafter, after thorough investigation, the chargesheet was filed and the trial court, after hearing the submissions of the parties and after appreciating the material placed on record, has passed the Judgment and order and thus, no interference is warranted by this Court.
