The instant appeal was filed in the year 2000 against conviction of the appellant in case No. 263 of 1994, under Sections 8/20(b)(ii) NDPS Act.
The Chief Judicial Magistrate, Muzaffarnagar has submitted a report in furtherance of an inquiry conducted by a Sub Inspector of Police regarding living status of the appellant and he has forwarded the statement of Gram Pradhan Village Khujeda, Police Station Kakrauli, who stated that the appellant Naseer Ahmad son of Abdul Sattar was resident of her village and he died about 15 to 20 years ago due to illness.
In view of the aforesaid report, the instant appeal stands abated .
