It is further submitted by the learned counsel for the appellant that as per FIR, two incidents are shown therein. One incident is dated 20.01.2016 at about 1.30 p.m. in the mid night, wherein the allegation is that the appellant knocked at the door of the complainant and when the complainant opened the door in the misconception that her husband might have come, the appellant pushed her down and on hue and cry of the complainant, her brother-in-law Sanjay Gond and Raj Kumar Gond came to rescue her. The appellant made good his escape and during this incident his one slipper was left on the spot. It is again the version of the FIR that on 21.01.2016 in the evening at 6.00 p.m. the appellant hurled caste coloured abuses. In the statements of the complainant Chandrawati Devi and her brother-in-law Sanjay Gond only incident dated 20.01.2016 has been mentioned wherein improvement of catching hold of the hand of the victim has been added along with allegation of pushing down the complainant. There is no allegation of any offence under SC/ST Act in any of the statements of the complainant or her brother-in-laws or the others. Again the attention of the court is drawn towards the bail order of the appellant, wherein the bail has been granted on the ground that the prima-facie case under Section 354 IPC cannot be said to be made out. Hence, bail was granted. The prayer is made that no offence under Section 3(1) (x) of SC/ST Act can be said to be made out against the appellant.
