Heard the learned counsel for the applicant, learned AGA for the State and perused the record.

The applicant has moved an application for cancellation of anticipatory bail granted to opposite party no. 2 Amit Kumar Rai in Case Crime No. 0067 of 2023, under Sections 420, 467, 468, 471,452,427,504,506,120-B, 383 IPC, P.S. Sector 49, District Commissionerate Gautam Budh Nagar.

Perused the application as well as the affidavit filed in support of the bail cancellation application. The grounds taken in the bail cancellation application for cancellation of bail granted to respondent no. 2 is that accused/respondent has breached the terms and conditions of the bail order dated 4.5.2023 granted by the court below and they are threatening the witnesses and tampering the evidences and still the police is also favouring the accused persons. The grounds shown in the affidavit are not sufficient to reverse the clock back for cancellation of the bail, which was granted to the respondent by the court below. There were no grounds to consider the application. Therefore this court is of the view that this is not a fit case to consider the request of the applicant.

Hence, the application stands dismissed without notice to the respondent at admission stage.
