It is submitted by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the present case. The incident was alleged to be occurred on 08.11.2022 and application was given to Police Station Kotwali, District Hamirpur on the same day stating therein that on account of road accident, the deceased has received grievous injuries and had died on account of injuries received in the alleged road accident. Thereafter on 09.11.2022, the first information report was lodged against the husband and the entire family members of husband side including the present applicant under Sections 498A, 323, 504 and 306 I.P.C.. The applicant is brother-in-law (Dever) of the deceased. The Panchayatnama of the victim was conducted on 09.11.2022 in which the informant was also one of the Panch but at that time, he has not disclosed the fact that deceased had committed suicide due to harassment by husband and in-laws. There is no direct evidence of abatement to commit suicide against the applicant and it is a case of accidental death. The applicant has no previous criminal history and there is no possibility of fleeing away from the judicial process or tampering with the witnesses and in case, the applicant is enlarged on bail, the applicant shall not misuse the liberty of bail. The applicant is in jail since 11.11.2022.
