By means of this second bail application under Section 439 of Cr.P.C., applicant-Ankit, who is involved in Case Crime No. 726 of 2018, under Section 302 of I.P.C., Police Station-Partapur, District-Meerut, seeks enlargement on bail during the pendency of trial.
First bail application of the applicant was rejected by the coordinate Bench of this Court vide order dated 06.12.2019 in Criminal Misc. Bail Application No. 40596 of 2019.
Perusal of order-sheet shows that matter is pending since March 2022.
Earlier on 23.02.2023 and 14.03.2023, the matter was taken up but none appeared on behalf of the applicant to press this bail application.
Today also, when case called out in revised list, none appears on behalf of the applicant to press this bail application, whereas learned A.G.A. for the State is present.
In view of the above, the instant bail application is dismissed for want of prosecution.
