- Heard learned counsel for the applicant as well as the learned AGA for the State and perused the material placed on record.
- This is the second bail application of the applicant. The first bail application of the applicant was rejected by Coordinate Bench of this Court.
- The instant bail application has been filed on behalf of the applicant, Savej, with a prayer to release him on bail in Case Crime No. 61 of 2021 under Sections 498-A and 304B IPC and Section 3/4 of D.P. Act, Police Station Khatauli, DistrictMuzaffarnagar during pendency of trial.
- There is allegation against the applicant of causing dowry death of his wife.
- Learned counsel for the applicant has submitted that before the trial court P.W.-1 and 2 have been examined, but they have been declared hostile. The applicant has been falsely implicated in this case. He has no criminal history to his credit and is languishing in jail since 25.01.2021. The trial in the aforesaid case is not likely to be concluded in near future.
