It is submitted by learned counsel for the applicant that applicant is innocent and has been falsely implicated in the present case due to ulterior motive. He further submits that on 19.08.20219 at about 11.30 p.m. the accused persons have beaten father and daughter of the informant and inflicted serious injuries on them. It is further contended that general role has been assigned to all the accused persons and no specific role has been assigned to the accused applicant. He next submits that police has registered FIR under Sections 323, 504, 325 IPC whereas after completion of investigation, police has submitted the charge sheet under Sections 323, 325, 504 and 308 IPC. He next argued that identically placed co-accused, Vikas @ Vicky @ Rajat and Satish, have been granted bail by the Co-ordinate Benches of this court vide orders dated 21.11.2022 and 24.01.2023 passed in Criminal Misc. Bail Application Nos. 48293 of 2022 and 2315 of 2023, thus applicant is also entitled to be enlarged on bail on the ground of parity as well. He further submits that applicant has no previous criminal history as mentioned in para 20 of the bail application and he is languishing in jail since 19.01.2023. In case, the applicant is released on bail, he will not misuse the liberty of bail and will cooperate in trial.
