Heard Sri Anand Pati Tiwari, learned counsel for the applicant, Sri Anand Vikram Singh learned counsel for the informant; learned AGA for the State and perused the material placed on record.
The instant bail application has been filed on behalf of the applicant, Sohil Sisodiya, with a prayer to release him on bail in Case Crime No.999 of 2022, under Section 364 I.P.C, Police Station Khurja Nagar, District Bulandshahr.
There is allegation in the first information report that the father of the informant was kidnapped by some unknown boys on 15.10.2022 in the morning at about 5.45 a.m.
Learned counsel for the applicant submits that the applicant was arrested by the police on 21.10.22 in a police encounter case crime no.1017 of 2022 and released on bail. He is student of B.Tech. He has submitted that the applicant has been implicated on the basis of the names heard by the abductee and their taking of name of the applicant by stating that applicant had got them involved in this incident. In the second statement of the abductee he has stated when he had gone for morning walk the applicant was standing on the road and from his demeanour it appeared that he was watching him and hence the implication of the applicant was made.
Learned counsel for the informant has vehemently opposed the bail application has submitted that the bail application of co-accused, Mudassir Ali @ Mudassir being Crl. Misc. Bail Application No.1854 of 2023, has already been rejected by coordinate bench of this court on
31.01.2023. He has further submitted that the applicant has been clearly named by the abductee.
Learned AGA has also opposed the prayer for bail of the applicant.
This Court after hearing the learned counsels for the parties does not finds any ground for enlarging the applicant on bail at this stage.
The bail application is accordingly rejected.
The trial court is directed to conclude the trial against the applicant as expeditiously as possible, preferable within a period of six months from the date of production of certified copy of this order.
