It is argued by learned counsel for the applicant that applicant is innocent and has been falsely implicated in the present case. It is further submitted that in gang chart, only one case has been shown against applicant, in which, he is already on bail, copy of bail order has been annexed as annexure- 3 to the bail application. It is also submitted that there is no material against the applicant to invoke the provisions of U.P. Gangster and Anti Social Activities (Prevention) Act. It is next submitted that criminal history of seven cases of the applicant except the case shown in gang chart,has been explained in paragraph no. 16 of the bail application. Co-accused Chand, Amir Khan and Mohsin have already been granted bail by the co-ordinate Bench of this Court vide order dated 13.10.2022, 24.11.2022 and 28.11.2022 in Crl. Misc. Bail Application Nos. 41917 of 2022, 50404 of 2022 and 54041 of 2022, copies of bail orders are annexed as Annexure no. 6 to bail application. It is also submitted that applicant is languishing in jail since 19.9.2022 and that in case he is released on bail, he will not misuse the liberty of bail and will cooperate in trial.
