This application has been filed with a prayer to release the accused applicant on bail in Case Crime No. 441 of 2020, under Sections 302, 404, 411, 34 IPC, Police Station Dhoomanganj, District Prayagraj (Allahabad).
Heard Sri Pramod Kumar Srivastava, learned counsel for the accused applicant and Sri D.P.S. Chauhan, learned Additional Government Advocate appearing on behalf of the State respondent.
Learned counsel for the accused applicant has submitted that the accused applicant is innocent and has falsely been implicated in the case. He further submitted that the accused applicant is not named in the first information report and his name, for the first time, has surfaced in the statement of the co-accused namely Aatish Kesarwani. He further submitted that the accused applicant does not have any criminal history and he is languishing in jail since 15.05.2020, so the accused applicant should be enlarged on bail.
Contrary to it, learned A.G.A. appearing on behalf of the State-respondent has vehemently opposed the bail application of the accused applicant and submitted that the accused applicant is a contract killer and he along with co-accused persons killed four persons of a family. He further submitted that recovery of weapon of crime i.e. knife has been made at the pointing out of the accused applicant.
