The submission advanced by learned counsel for the applicant is that the applicant is innocent and has been falsely implicated in the present case due to ulterior motive. The applicant is not named in the first information report, after six months of the incident, the name of the applicant came into light during investigation in the confessional statement of co-accused Yogesh Kushwaha for driving the vehicle. The applicant has already been released on bail by this court in Crl. Misc. Bail Application No. 55556 of 2022 on 19.04.2023 which pertains to under sections 302, 201, 364, 394, 380, 411, 323, 506, 34 IPC, P.S. Sadar Bazar, District Mathura (page No. 7 of the supplementary affidavit filed in support of the bail application). Therefore, the applicant may also be released on bail in the aforesaid case crime no. .Several other submissions in order to demonstrate the falsity of the allegations made against the applicant have also been placed before the Court. The circumstances which, according to the counsel, led to the false implication of the accused have also been mentioned.
