The instant bail application, under Section 439 Cr.P.C., has been filed with a prayer to enlarge the applicant on bail in Case Crime No. 400 of 2022, under Sections 307, 323, 324, 504 and 506 I.P.C., Police Station- Najibabad, DistrictBijnor during the pendency of trial.
According to the prosecution case, the applicant armed with a knife caused three injuries to the father of the informant on the chest, left arm and forearm. The medical report discloses that the injuries are grievous in nature. The prosecution case is supported by the informant as well as the injured and the medical examination report of the injured corroborates the prosecution case. Specific role has been assigned to the applicant.
Learned counsel for the applicant has submitted that on account of old enmity, the applicant has been falsely implicated in the instant case. He has no criminal history to his credit.
