It has been submitted by learned counsel for the applicant that the name of the applicant has surfaced in the statement of the coaccused, namely, Ram Prakash Nirala under Section 161 of Cr.P.C. Bail to the other co-accused, namely, Raj Singh Verma @ Raj Patel and Avinash Kumar Patel has already been granted by the coordinate Bench of this Court in Criminal Misc. Bail Application Nos. 24523 of 2023 and 10915 of 2023 vide orders dated 07.06.2023 and 15.05.2023 respectively. The role of the applicant is same as of the co-accused, hence, the applicant is also entitled for bail on the ground of parity. He next contended that the applicant is innocent and has been falsely implicated in the present case due to ulterior motive. Nothing incriminating has been recovered from the possession of the accused applicant. There is no other criminal history of the applicant, except this case as averred in paragraph 22 of the Bail Application. The applicant is a student of B.P.Ed and has good academic record. The applicant is languishing in jail since 17.11.2022. In case, the applicant is released on bail, he will not misuse the liberty of bail and cooperate in trial.
