The submission advanced by learned counsel for the applicant is that the applicant is innocent and has been falsely implicated in the present case due to ulterior motive. During the course of medical examination, the victim has stated that she knows the applicant Suresh for the last two years, she is major, they love to each other, she went with the applicant with her free will and consent and solemnized the marriage with the applicant and wants to live with Suresh, if she went to her home, the parents will kill her. It shows that the victim is consenting with the applicant. According to medical examination report no sign of rape has been found on the body of the victim and also there is a lot of contradiction in the statement of the victim recorded under section 161 and 164 Cr.P.C. Several other submissions in order to demonstrate the falsity of the allegations made against the applicant have also been placed before the Court. The circumstances which, according to the counsel, led to the false implication of the accused have also been mentioned. It has also been assured on behalf of the applicant that he is ready to cooperate with the process of law and shall faithfully make himself available before the court whenever required and is also ready to accept all the conditions which the Court may deem fit to impose upon him. It is further contended by learned counsel for the applicant that the applicant is languishing in jail since 22.07.2022 having no criminal history.
