Heard learned counsel for the applicant, learned counsel for the first informant and learned A.G.A on behalf of the State and perused the record.
The instant bail application has been filed on behalf of the applicant Ranjeet Kumar with a prayer to release him on bail in Case Crime No. 415 of 2022, u/s 307, 504, 506 I.P.C., P.S. Sikandrarao, District Hathras, during pendency of the trial.
Learned counsel for the applicant states that the applicant is innocent and has been falsely implicated in the present case. It is further submitted that the injured in his statement has stated that he remained in hospital till 30.8.2022 but other evidence disclose otherwise and as such the statement of the injured is not reliable. The applicant also lodged an F.I.R., which was registered after two months of the incident. Applicant is not a previous convict and is languishing in jail since 12.8.2022.
Per contra, learned counsel for the informant and learned A.G.A opposed the bail application of the applicant and argued that the role of firing has been assigned to the applicant and the injured has received grievous injuries i.e. (i) wound of size 3cm. x 1½cm. on arm axillary lower blackening and bleeding on left side of abdomen and (ii) wound 1cm. x 1cm. left side of body on front axillary. It is further argued by learned counsel for the informant that the statement of injured has also supported the F.I.R. version and medical, hence the applicant is not entitled for bail.
Considering the submission advanced by learned counsel for the parties and as it is evident from the record that the applicant has been assigned the role of causing injuries to the injured which are grievous in nature, hence I find no good ground for grant of bail to the applicant in the aforesaid case.
The bail application is, accordingly, rejected .
