The instant bail application has been filed on behalf of the applicant, Hanuman Tiwari , with a prayer to release him on bail in Case Crime No. 331 OF 2022, under Sections 302,307,452,34 IPC, Police Station Naini, District- Prayagraj, during pendency of trial.
There are allegations against applicant that he alongwith co-accused, Shiv Prasad Tiwari and Rajababu Mishra entered into house of informant and shot his younger brother, Ashish Tiwari alias Baua dead. His second and third brothers,namely, Lavkush Tiwari and Rama Shanker Tiwari were shot upon by pistol, who were admitted in hospital.
Learned Senior counsel for the applicant has submitted that co-accused, Raja Babu Mishra and Shiv Prasad Tiwari have already been enlarged on bail.
Learned counsel for the informant and learned AGA have vehemently opposed the prayer for bail of the applicant.
This court after going through the order passed in Shiv Prasad Tiwari, finds that eye witness of the incident has assigned the role of causing fatal injury on the head of the deceased to the applicant. This fact has been considered by this court while granting bail to the coaccused, Shiv Prasad Tiwari by the order dated 21.7.2023 in Criminal Misc. Bail Application No. 31920 of 2023 by the following order:-
“व्ቔ�मान दाቄኌ��क ्ቚकी्ቓ� जमान्ቔ ्ቚा्ቕ�ना प्ቔ , आवेदक शि�व ्ቚसाद ति्ቔवारी की ओर से मु०अ०सं० 331/2022, अन ् �्ቔ धारा 302/307/452/34 भा०दं०विव०, ाना नैनी, जिजला ्ቚया्ቇराज में जमान्ቔ पर मु्ሹ करने हे्ቔु ्ቚस ् विकया ्ቇया है। ा आवेदक के विव्ቛान अतिधव्ሹा, एवं विव्ቛान अपर �ासकीय अतिधव्ሹा को सुना ्ቔ्ቕ प्ቔवली का परिर�ीलन विकया।
आवेदक के विव्ቛान अतिधव्ሹा ने ्ቔक� ्ቚस ् विकया विक आवेदक को इस ्ቚकर्ቓ में्ቇ ल्ቔ एवं फज5 ढं्ቇ से झूठा फंसाया ्ቇया है, उसने कशि्ቕ्ቔ अपराध कारिर्ቔ नहीं विकया है, बयान चश्मदीद ्ቇवाह के बयान ने ब्ቔाया विक ”विदनांक 05.07.2022 को समय ल्ቇभ्ቇ 11.30 बजे हनुमान ति्ቔवारी व उनका भाई शि�व ्ቚसाद ति्ቔवारी व उनके रिरस ् ेदार राजा विम्ቦा जो सुरिरयाभीट में रह्ቔे है। मेरे दरवाजे पर चढ़ आये ्ቕे ्ቔो हम लो्ቇ घर के अन्दर घुस ्ቇये ्ቕे। ्ቔब मुቄኌEजमान उपरो्ሹ घर के अन्दर घुसकर बटों से मारपीट करने ल्ቇे। हनुमान ति्ቔवारी व शि�व्ቚसाद ति्ቔवारी अपनी अपनी लाइसेंसी दुनाली बन्दूकों से मुझे ्ቔ्ቕ ा मेरे भाई लवकु� ति्ቔवारी व आ�ीष ति्ቔवारी को जान से

मारने की विनय्ቔ से कई फायर विकये। राजा बाबू विम्ቦा जोर-जोर से तिच्ቤा रहा ्ቕा और कह रहा ्ቕा कोई आज बचने ना पाये। ्ቔ ब मरा भाई आ�ीष ते ि्ቔ वारी बाहर ्ቇ ली म जानें बचाकर भा्ቇ ा ्ቔ भी हनुमान ति्ቔ वारी ने मरे े भाई आ�ीष ति्ቔ वारी के सर में ्ቇ ोली मार वदया जि जससि े मरे े भाई आ�ीष ति्ቔ वारी के मौके पर ही मृतय् ु हो ्ቇ यी ्ቕ ी, ्ቇोली मरे े भाई " लवक� तु ि्ቔ वारी को भी छू्ቔे हुए वनकल ि ्ቇ ई।
उ्ሹ चश्मदीद ्ቇवाह के बयान से यह स्प्ቖ हो जा्ቔा है विक ्ቔ्ቕ ाकशि्ቕ्ቔ घटना कारिर्ቔ ा वह करने में मुख्य भूविमका हनुमान ति्ቔवारी की है। इस ्ቚकार आवेदक विनदPष है ्ቔ्ቕ इस ्ቚकर्ቓ में विद० 07.07.2022 से कारा्ቇार में विनरू्ቍ है इसलिलए आवेदक को जमान्ቔ पर छोड़ विदया जाय।
विव्ቛान अपर �ासकीय अतिधव्ሹा ने आवेदक के विव्ቛान अतिधव्ሹा के ्ቔकP का ्ቚबल विवरोध कर्ቔे हुए ्ቔक� ्ቚस ् विकया विक आवेदक ्ቛारा कारिर्ቔ अपराध सं्ሺेय एवं ्ቇम्भीर्ቚ कृति्ቔ का है, इसलिलए आवेदक को जमान्ቔ पर न छोड़ा जाये।
आवेदक के विव्ቛान अतिधव्ሹा के ्ቔकW के परिर्ቚेቌኚय में प्ቔावली पर उपलब्ध सारवान्ቔ थ्यों एवं परिरቄኌस ् ति्ቔयों का सम्ቇ रूप से अवलोकन करने के बाद , सबू्ቔों की ्ቚकृति्ቔ और विकसी भी ठोस विवरोधात्मक साम्ቇी की अनुपቄኌस ् ति्ቔ एवं उपलब्ध साम्ቇी से छेड़छाड़ की संभावना न होने के ्ቔथ्य को देख्ቔे हुए मेरी राय में आवेदक को जमान्ቔ पर मु्ሹ करने का उपयु्ሹ आधार है।
अ्ቔः वाद के ्ቇु्ቓ दोष पर विबना कोई विटप्प्ቓी विकए हुए आवेदक को उपरो्ሹ वቓኌ्ቓ्ቔ अपराध में संबंतिध्ቔ न्यायालय की सन ् ुवि्ቖ पर व्यवि्ሹ्ቇ्ቔ बंध -प्ቔ एवं अतिधक धनराशि� के दो स ् ानीय ्ቚति्ቔभू ्ቚस ् करने पर विनम्नलिललिख्ቔ �्ቔW के सा्ቕ जमान्ቔ पर छोड़ विदया जाय।
1- आवेदक विववेचना या परी्ቌ्ቓ के दौरान अशिभयोजन साቌኚयों के सा्ቕ छेड़छाड़ नहीं करे्ቇा।

3- आवेदक न्यायालय के आदे�ों का पालन करे्ቇा, वह परी्ቌ्ቓ के दौरान विबना ा कोई अनावश्यक स ् न लिलए विनय्ቔ ति्ቔशि्ቕ पर न्यायालय में उपቄኌस ् हो्ቇा ्ቔ्ቕ परी्ቌ्ቓ में ईमानदारी से सहयो्ቇ करे्ቇा।
4- आवेदक जमान्ቔ पर रिरहा होने के बाद जमान्ቔ की स्व्ቔं्ቔ्ቔ ा का दुरूपयो्ቇ नहीं करे्ቇा और विकसी भी अपरातिधक ्ቇति्ቔविवतिध में लिल् नहीं हो्ቇा न ही कोई अपरातिधक कृत्य करे्ቇा।
5- आवेदक ्ቚत्य्ቌ या अ्ቚत्य्ቌ रूप से मामले के ्ቔथ्यों से परिरतिच्ቔ विकसी भी व्यवि्ሹ या पुलिलस अतिधकारिरयों को कोई ्ቚलोभन या धमकी नहीं दे्ቇा न ही उनसे कोई वायदा करे्ቇा, जिजसके कार्ቓ उन्हें न्यायालय में ्ቔथ्यों को उजाकर करने से विवर्ቔ रहना पड़े
उपरो्ሹ �्ቔW में से विकसी के उ्ቤंघन के मामले में , परी्ቌ्ቓ न्यायालय आवेदक की जमान्ቔ विनयमानुसार र्ቌ करने को स्व्ቔं्ቔ है।"
In view of the above,role of the applicant recorded by the court in the order of co-accused. there is no justification of enlarging the applicant on bail
The bail application is accordingly rejected.
The court below is directed to conclude the trial against the applicant, as expeditiously as possible, preferably within a period of one year from the date of production of certified copy of this order as per section 309 Cr.P.C..
