It has been contended by the learned counsel for the applicant that applicant is innocent and he has been falsely implicated in the present case due to ulterior motive. It is next contended that the first information report of the alleged incident is delayed for which no plausible explanation has been given which itself falsify the prosecution story. It is further submitted that no incriminating article or any spurious wine has been recovered from the possession of the applicant and only on the basis of suspicion the name of the applicant surfaced. He further argued that co-accused Digpal is only license holder of country made liquor shop of the year 2021-22, who has already been granted bail. He also submitted that applicant was the only manager of the shop and other managers who have already been granted bail. It is further submitted that the co-accused namely Anil Chaudhary, Rishi Sharma, Munish Sharma, Gangaram Pradhan, Shiv Kumar Yadav, Digpal Singh, Kapil Sharma and Vipin Yadav @ Ombeer Singh have already been granted bail by coordinate Bench of this Court vide orders dated 19.05.2022, 10.06.2022, 04.07.2022, 24.03.2022, 21.10.2022, 22.08.2022, 22.12.2021, 22.08.2022 passed in Criminal Misc. Bail Application Nos. 16333 of 2022, 17363 of 2022, 16978 of 2022, 1853 of 2022, 1723 of 2022, 5203 of 2022,51439 of 2022 and 5545 of 2022, a copy of said orders have been produced by learned counsel for the applicant which is taken on record.
