Heard learned counsel for the applicant, learned Additional Government Advocate representing the State and perused the record.
By means of this application under Section 439 of Cr.P.C., applicant Sukhveer Singh, who is involved in Case Crime No. 203 of 2021 under Sections 147, 148, 149, 452, 323, 302, 506, 34 IPC, police station Shergarh, district Mathura, seeks enlargement on bail during the pendency of trial.
As per prosecution case, in brief, the informant who is brother of deceased Ratan Singh and Rajesh Kumar lodged an FIR on 12.08.2021 against the present applicant Sukhveer and seven others namely Hari Om, Pawan, Kunj Bihari, Amar Singh, Deshraj, Arvind and Satish with the allegation inter-alia that on 11.08.2021 at about 5:30 p.m., accused persons armed with lathi-danda and other weapons barged into the house of his brother Ran Singh and started beating him. On hearing shrike of Ran Singh, he along with his brother Ratan Singh and Rajesh Kumar, reached the house of Ran Singh and saw that the accused persons were badly beating Ran Singh. When they tried to save Ran Singh, the present applicant Sukhveer Singh and Hari Om fired at his brother Ratan Singh and Rajesh Kumar which hit to them and they died at the spot. Thereafter, the accused persons ran away giving threat to him.
