1. Heard Sri Mohammad Belal, learned counsel for the applicant, Sri Yogesh Mishra, learned A.G.A. for the State and perused the material placed on record.

1. Applicant seeks bail in Case Crime No.414 of 2023, under Sections 3/5A/8 Cow Slaughter Act, Police Station Garhmukteshwar, District Hapur, during the pendency of trial.

1. Learned counsel for the applicant has argued that the applicant has been falsely implicated in the present case. Admittedly, the applicant is not named in the FIR and his name has come up in the confessional statement of co-accused person, which is not admissible in evidence. The criminal history of three cases assigned to the applicant stands explained in paragraph-18 of the affidavit filed with the bail application. Several other submissions have been made on behalf of the applicant to demonstrate the falsity of the allegations made against him. The circumstances which, as per counsel, led to the false implication of the applicant have also been touched upon at length. The applicant is languishing in jail since 12.9.2023. In case, the applicant is released on bail, he will not misuse the liberty of bail.
