Having heard learned counsel for the parties and examined the matter in its entirety, I find that the instant matter was earlier heard by this Court and on the issue of fair investigation, an explanation was called for from the investigating ofÏcer of this case vide orders dated 20.01.2023 and 24.01.2023 and thereafter, the investigating ofÏcer has recorded the statement of eye witness namely Golu, Sonu and Monu and recorded the same in C.D. No. XI dated 26.01.2023. On 30.01.2023, at the time of hearing eye-witnesses namely Monu and Sonu, who were present before this Court and they, in presence of all the investigating ofÏcers, have stated that they have not given such statements which have been recorded by the third investigating ofÏcer of this case in above mentioned C.D No. XI. Thereafter, the matter was referred to Commissioner of Police, Prayagraj to look into the matter and to take appropriate action against the erring investigating ofÏcer upon which, an inquiry was conducted and the third investigating ofÏcer i.e. SI Govind Ram was found guilty in not conducting fair investigation by the inquiry report dated 20.02.2023, therefore, a show cause notice dated 21.02.2023 was issued to him and after that, censure entry was awarded to SI Govind Ram and the same was entered at page no. 77 of his service record on 13.03.2023.
