Heard learned counsel for the applicant and learned A.G.A. for the State and perused the record.
The instant bail application has been filed on behalf of the applicant with a prayer to release him on bail in Case Crime No.494 of 2022, under Sections 409, 420 I.P.C., P.S. Kotwali, District Fatehpur, during pendency of the trial.
It is alleged in the F.I.R. that in compliance of the order of District Magistrate dated 24.05.2022, first informant and other officers reached on the spot to forfeit the sealed godowns of applicant and they found one additional lock upon the godowns and found that walls of godowns were newly constructed and some stock found less then the stocks seized on 08.12.2020.
Earlier the F.I.R. was lodged against the applicant in Case Crime No.823 of 2020, under Section 3/7 Essential Commodities Act, regarding illegal storage of fertilizer and wheat seeds and in aforesaid case crime, the applicant was granted bail by Co-ordinate Bench of this Court vide order dated 12.02.2021 passed in Crl. Misc. Bail Application No.9794 of 2021. The applicant is proprietor of firm having valid retail license. Godowns were sealed and handed over into custody of applicant on 08.12.2020 and sent to jail on 09.12.2020.
