Heard learned counsel for the applicant, learned AGA for the State and perused the record.

The instant bail application has been filed with the prayer to enlarge the applicant on bail in Case Crime No.273 of 2023, under Sections 392, 411 IPC, Police Station Bakevar, District Etawah, during the pendency of the trial.

Learned counsel for the applicant submits that the applicant in innocent and has been falsely implicated in this case. A false recovery of a ring made of yellow metal has been shown from his possession regarding which there is no identification. It is further submitted that the applicant has no previous criminal history. He is in jail since 13.07.2023 and if he is released on bail, he will not misuse the said liberty.

Learned AGA has opposed the prayer for bail but could not satisfactorily dispute the aforesaid submissions from the record.

Having regard to the submissions made but without commenting on merits of the case, this Court is of the opinion that the applicant is entitled to be enlarged on bail.

Let the applicant - Harendra @ Kallu , involved in the aforesaid case, be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of Court concerned subject to the conditions that he:

(i) shall appear on the date fixed by the trial court;

¶13

(ii) shall not tamper with the prosecution evidence; and,

¶14

(iii) shall not pressurize the prosecution witnesses.

¶15

In case of breach of any of the above conditions, the prosecution shall be at liberty to move bail cancellation

application before this Court.
