It is argued by the learned counsel for the applicant that applicant is innocent and he has been falsely implicated in the present case. He further argued that missing report of deceased Devraj was lodged on 26.10.2021 by Smt. Phoiolmati that her husband has disappeared and is not traceable. Thereafter, the dead body of the deceased Devraj was recovered and was identified by his wife. Inquest was prepared and thereafter postmortem report was conducted on 30.10.2021. False recovery of Sabbal and Chapad were shown to be recovered on the pointing out of the applicant, while same was admitted to be recovered on the pointing out of co-accused Umesh Paswan. During the investigation, the mother, brother and uncle of the deceased introduced their theory that wife of the deceased having illicit relation with the applicant. The wife of the deceased was also made an accused. The confessional statements of applicant and co-accused were allegedly recorded by the Investigating Officer. No call detail record of the mobile number of applicant and the deceased to show location of applicant with another accused. There is no F.S.L. report, which shows that alleged Chapad which was shown to be recovered from the possession of the applicant was used in the crime. It is further submitted that Charge sheet has been filed against the applicant and co-accused on 29.11.2021. He further submits that no recovery was made either from the possession or pointing out of the applicant. The alleged recovery is planted recovery which is not supported by any independent witness. The investigation was not fairly conducted by the Investigating Officer. No specific role has been attributed to the applicant in the statements of witnesses. He further argued that the applicant
